Mental health professionals are increasingly navigating concerns about client privacy, subpoenas, insurance audits, electronic health records, and the potential misuse of sensitive information. This training explores ethical and legally sound documentation practices that protect client confidentiality while meeting clinical, regulatory, and risk-management requirements. Participants will examine the distinction between progress notes and psychotherapy notes, apply the HIPAA minimum-necessary standard to documentation, and learn practical strategies for writing concise, clinically useful notes that support treatment without including unnecessary sensitive details. Special attention will be given to documenting work involving trauma, identity exploration, reproductive concerns, substance use, and other sensitive topics in a manner that balances client safety, continuity of care, and professional obligations.
By attending this training, you will be able to:
1. Differentiate between progress notes and psychotherapy notes.
2. Explain the distinct legal protections afforded to each under HIPAA.
3. Apply the minimum necessary standard to clinical documentation.
4. Identify information that is essential for treatment, billing, and continuity of care versus information that may create unnecessary privacy risks.
5. Use documentation strategies that maintain clinical effectiveness, support ethical practice, and protect client confidentiality in electronic and paper health records.
Brianne Rose-Baker, or Bri, is a Licensed Mental Health Counselor with more than a decade of experience supporting adolescents and adults navigating trauma, depression, anxiety, identity exploration, relationship concerns, and anger management. She specializes in complex trauma and works from a relational, trauma-informed approach, integrating evidence-based modalities including Cognitive Behavioral Therapy, Dialectical Behavior Therapy, Narrative Therapy, and Neurofeedback.
Outside of the therapy room, Bri is also a fiction writer whose work explores themes of trauma, identity, and human connection. Her writing has been published in Claudine Literary, and she is an active member of the Northern California Writers Retreat group, blending clinical insight with compelling storytelling. This creative perspective enriches her approach to therapy and instruction, helping clinicians think critically about the narratives people carry and the ways stories shape healing.
